Two men, Ojemiyiwa Fatope and Christian John, were on Monday, arraigned before an Ile-Ife Magistrates’ Court, over alleged theft of palm fruits worth N1 million.
Fatope, 40, and John, 35, are being charged with forcible entry, malicious damage, stealing and conduct likely to breach public peace.
The Prosecutor, Insp Saheed Anifowose, told the court that the defendants committed the offence in February at Fadehan Village, Ile-Ife.
Anifowose said that Fatope and John stole palm fruits valued at N1 million, belonging to the complainant, Chief Isaac Olubamiji.
He said that the defendants forcibly entered a farmland belonging to Olubamiji, and wilfully damaged his crops.
The prosecutor said that the offence contravened Section 8 of the Osun State Forceful Entry and Illegal Occupation of Landed Properties (Prohibition), Law, 2019.
Anifowose further said that offence contravened Sections 383, 249(4), 390(9), 451 and 516 of the Criminal Code, Laws of Osun State, 2002.
The Defence Counsel, Mr Keji Adegoke, prayed the court to admit his clients to bail in the most liberal terms, and promised that they would not jump bail.
Magistrate Abosede Sarumi, granted the defendants bail in the sum of N250,000, with two sureties in like sum.
Sarumi said that the sureties must swear to an affidavit of means, and should reside within the court’s jurisdiction.
The magistrate also ordered that the addresses of the sureties must be verified, and that they should present three years tax payment to the state government.
Sarumi adjourned the case until March 28, for hearing.
